Domestic and foreign commercial food processors are required to provide FDA, upon written request, any information concerning processes and procedures deemed necessary to determine the adequacy of the process in accordance with the low-acid canned food (LACF) and acidified foods (AF) regulations.
All commercial processors of LACF and AF (unless excluded) must file their scheduled processes with FDA. FDA routinely conducts technical review and assessment of the filed information. In situations where this review concludes further information is necessary to determine the adequacy of the filed process, FDA may issue a written request for such information. For foreign commercial processors, failure to provide this information within a timely manner may result in FDA's refusal of the processors' products admission into the United States. FDA considers the lack of providing this information, pursuant to written request, an appearance that the articles are not being produced in accordance with the applicable requirements of 21 CFR Parts 108, 113, and/or 114.
